HeyNeighbour Terms of Use

These Terms of Use ("Terms") apply when you access or use HeyNeighbour, a service provided by iLet Technologies Limited, trading as Holt ("Holt", "we", "our" or "us").

HeyNeighbour allows prospective tenants to view rental properties, create a reusable rental profile, submit applications for properties and manage information relating to those applications.

By creating an account or using HeyNeighbour, you agree to these Terms.

1. Who We Are

2. Using HeyNeighbour

You must be at least 18 years old to create a HeyNeighbour account or submit a rental application.

You agree to provide information that is accurate and complete to the best of your knowledge and to keep relevant account information reasonably up to date.

You must not:

  • create an account using another person's identity;
  • knowingly provide false or misleading information;
  • upload documents that you do not have the right to provide;
  • attempt to gain unauthorised access to another person's account;
  • interfere with the operation or security of HeyNeighbour;
  • use automated tools to scrape or extract information from the service without our permission; or
  • use HeyNeighbour for unlawful or fraudulent purposes.

3. Your Account

You are responsible for maintaining the security of your account and login credentials.

You should notify us if you believe your account has been accessed without your permission.

We may take reasonable steps to protect accounts and the service, including requiring authentication, restricting access or temporarily suspending an account where we reasonably believe there is a security risk or misuse of the service.

4. Rental Listings

Properties displayed on HeyNeighbour are generally advertised by landlords, letting agents or property managers using Holt's services.

Property information may include information supplied by those organisations, including rent, availability, photographs, descriptions, property features and other listing information.

We aim to display the information provided to us accurately, but Holt does not independently guarantee that every item of property information is complete, accurate or current.

Property availability, rent and other listing information may change.

You should confirm any information that is important to you with the landlord, letting agent or property manager before entering into a tenancy.

5. Rental Applications

HeyNeighbour allows you to submit applications for rental properties.

Submitting an application:

  • does not guarantee that you will be offered a property;
  • does not reserve a property unless expressly stated otherwise;
  • does not create a tenancy agreement; and
  • does not require a landlord, letting agent or property manager to accept your application.

The landlord, property owner, letting agent or property manager responsible for the property determines whether an application progresses and whether a tenancy is offered.

Holt does not make the final decision to offer or refuse a tenancy.

6. Your HeyNeighbour Profile

HeyNeighbour may allow you to create and maintain a reusable tenant profile.

Your profile may contain information and documents that can be used when applying for properties, reducing the need to provide the same information repeatedly.

Creating a HeyNeighbour profile does not make your information generally available to landlords or letting agents.

When you choose to apply for a property, relevant information from your profile and application may be made available to the landlord, letting agent or property manager responsible for that property.

How personal information is processed is explained further in our Privacy Policy.

7. Documents and Information You Provide

You are responsible for ensuring that information and documents you submit through HeyNeighbour are accurate to the best of your knowledge and that you are entitled to provide them.

Documents may include proof of identity, proof of address, employment information, income information, references and other information requested as part of a rental application.

You retain ownership of documents and information you provide.

You give Holt permission to host, process and make that information available as necessary to provide HeyNeighbour and process applications you choose to submit, subject to our Privacy Policy and applicable law.

8. Other People's Information

If you provide information about another person, such as a co-applicant, household member, guarantor or referee, you must have a legitimate reason for providing that information and must not knowingly provide information unlawfully.

Where appropriate, the other person may be asked to provide information directly or create their own account.

9. Application Assessment

HeyNeighbour and related Holt services may provide tools that help landlords, letting agents and property managers organise and assess rental applications.

These tools may assist with application requirements, eligibility information, application completeness and other information relevant to the application process.

They are intended to support the application process.

The final decision about whether to progress an application or offer a tenancy remains with the relevant landlord, property owner, letting agent or property manager.

10. Holt's Role

Holt provides the technology used to operate HeyNeighbour and related Holt services.

Unless expressly stated otherwise in relation to a particular property, Holt is not the landlord, property owner or letting agent and is not a party to any tenancy agreement entered into between you and a landlord.

Any tenancy ultimately entered into is between the parties identified in that tenancy agreement.

Questions relating to a particular property's availability, viewing, application decision or proposed tenancy may need to be addressed to the landlord, letting agent or property manager responsible for that property.

11. Availability of HeyNeighbour

We aim to keep HeyNeighbour available and operating reliably.

However, we cannot guarantee that the service will always be uninterrupted or error-free.

We may temporarily restrict access where reasonably necessary for maintenance, security, updates or circumstances outside our reasonable control.

We may also change or improve features of HeyNeighbour over time.

Nothing in these Terms excludes or limits any rights you have under applicable consumer law that cannot lawfully be excluded or limited.

12. Suspension or Termination

We may restrict or suspend access to HeyNeighbour where reasonably necessary, including where:

  • you materially breach these Terms;
  • we reasonably suspect fraud or unlawful activity;
  • your account creates a security risk;
  • you attempt to interfere with the service or another user's account; or
  • we are required to do so by law.

Where appropriate, we will provide reasonable information about the reason for the restriction or suspension.

You may stop using HeyNeighbour at any time.

Requests concerning deletion of personal information are handled in accordance with our Privacy Policy and applicable data-protection law.

13. Intellectual Property

HeyNeighbour, Holt and the software, design, branding and other materials forming part of our services are owned by or licensed to iLet Technologies Limited and are protected by applicable intellectual-property laws.

These Terms give you permission to use HeyNeighbour for its intended purpose. They do not transfer ownership of Holt's intellectual property to you.

Property photographs, descriptions and other listing materials may belong to landlords, agents or other third parties.

14. Our Responsibility

We are responsible for providing HeyNeighbour in accordance with applicable law and these Terms.

Holt is not responsible for decisions independently made by landlords, property owners, letting agents or property managers, including decisions about which applicants progress or are offered a tenancy.

We are also not responsible for the performance of a tenancy agreement to which Holt is not a party.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, or affects any mandatory rights or remedies available to you under applicable consumer law.

15. Privacy and Cookies

Our Privacy Policy explains how personal information is collected, used, shared and protected when you use HeyNeighbour.

Our Cookie Policy explains the cookies and similar technologies used by our services.

These documents should be read alongside these Terms.

16. Changes to These Terms

We may update these Terms where reasonably necessary, including to reflect changes to HeyNeighbour, applicable law or our business.

The current version of the Terms will be made available through HeyNeighbour together with its effective date.

Where a change materially affects existing users' rights or obligations, we will provide appropriate notice where required.

17. Governing Law

These Terms are governed by the laws of Ireland.

If you are a consumer living outside Ireland, you may also have mandatory rights under the laws of the country in which you live. Nothing in these Terms is intended to deprive you of protections that apply to you and cannot lawfully be excluded by contract.
